After several months of consultation and discussion, the European Commission published a delegated act 2024/2769 on the introduction of a new system of Assessment and Verification of Constancy of Performance 3+ (or system AVCP 3+), which came into force on 17th of November 2024.
This delegated act is the first step towards assessing the environmental impact of construction products. The objective of the European Commission is to be able to assess every new construction building on their environmental performance. For this, each construction product shall deliver environmental impacts in its Declaration of Performance (DoP). These aspects will be declined into the new Construction Product Regulation (CPR).
According to this delegated regulation 2024/2769, the manufacturer shall carry out:
- the assessment of the performance of the product on the basis of data collection for input values, assumptions and modelling
- factory production control
In brief, the manufacturer shall carry out a Life Cycle Analysis (LCA) or an Environmental Product Declaration (EPD) by himself or through a subcontractor.
According to this delegated regulation 2024/2769, the notified assessment validation body shall decide on the issuing, restriction, suspension or withdrawal of the validation report of constancy of performance of the construction product on the basis of the outcome of the following assessments and verifications carried out by that body:
- validation of the input values, assumptions made and compliance with applicable generic or product category specific rules
- validation of the manufacturer’s assessment
- validation of the process applied to generate that assessment
- validation of the correct usage of software appropriate for the assessment
- initial inspection of the manufacturing plant to validate any company-specific data
The new CPR has been adopted (November 5th, 2024) by the Council and publication is expected. The first harmonized standards (hENs) product categories that will contain environmental sustainability characteristics through the new CPR will be precast concrete products, structural metallic products, reinforcing and prestressing steel for concrete, doors, windows, shutters, gates and related buildings hardware, cement and thermal insulation products.
The first hEN product category will be published at the end of 2025 at the earliest. One year of coexistence between old and new hEN versions will be introduced to let the manufacturers prepare for the new CE marking requirements. Efectis will request notification on hENs (and horizontal notification) that contain environmental sustainability characteristics and in which we have expertise.
