The use of facilities other than the laboratories of Notified Bodies for testing electrical cables covered by EN 50575: Power, control and communication cables – Cables for general applications in construction works subject to reaction to fire requirements, is governed by Article 44 (Article 46) of the Construction Products Regulation (EU) No. 305/2011.
APPLICATION
Use of facilities other than those of the Notified Body for testing:
1) At the request of the manufacturer and where justified by technical, economic or logistical reasons, Notified Bodies may decide to carry out the tests specified in Annex V of the CPR, or have them carried out under their supervision in the manufacturer’s facilities or in the facilities of a Notified Body, for the assessment and verification of constancy of performance under AVCP Systems 1+ and 3.
- Testing may be carried out in an external laboratory using the manufacturer’s testing equipment, subject to prior agreement with the manufacturer.
- Efectis personnel conducting such tests are specifically authorized to operate in laboratories other than their own accredited testing laboratories.
2) Before conducting these tests, Efectis verifies whether the requirements of the test method are fulfilled and assesses the following aspects:
- Whether the test is supported by an appropriate calibration system and measurement traceability is ensured;
- Whether the quality of the test results is guaranteed.
- The technical, economic or logistical reasons put forward by the manufacturer are analyzed, and their validity is justified in the test report.
- The conditions required for performing the tests are as follows:
- Verification of the testing equipment by a competent Efectis representative;
- Verification of calibrations, annual inspections and daily checks;
- Performance of a comparative pre-test (this requirement may be deemed fulfilled if the manufacturer has previously carried out testing at the Efectis laboratory and can provide a comparative test performed using its own testing equipment, provided that the comparability of the results has been confirmed);
- For EN 50399 testing, at least one ladder shall be inspected in advance by a competent representative (technical expert) of Efectis (fixing method, installation details, spacing, etc.), followed by approval of the installation and verification of the installation of the remaining ladders before testing;
- The tests shall be carried out on the manufacturer’s testing equipment under the supervision of an authorized representative of Efectis;
- Collection of raw test data for analysis and preparation of the test report and classification report by the authorized representative of Efectis.
ACCREDITATION AND COMPETENCE OF EFECTIS PERSONNEL
The Efectis personnel responsible for carrying out or supervising the tests under Article 44 (Article 46) of Construction Products Regulation (EU) No. 305/2011 are duly authorized for the relevant test methods.
MANUFACTURER’S REQUEST AND VERIFICATION CONDITIONS
The manufacturer shall clearly and explicitly justify its request in writing. The application of Article 44 (Article 46) shall be analyzed and documented in a report setting out the justified reasons for accepting or rejecting the request.
CONTROL OF THE QUALITY OF RESULTS
Comparison of test results based on historical data (tests carried out on the same cable by the Efectis laboratory and tests performed by the laboratory where testing under Article 44 (Article 46) is to be conducted) shall be completed before verification of the suitability of the equipment.
If comparison of test results/data indicates different classifications, the worst-case performance shall prevail and, where necessary, additional testing shall be carried out. In such cases, the applicability of Article 44 (Article 46) shall be reassessed.
VERIFICATION OF THE SUITABILITY OF RESOURCES AND METHODS
Accreditation to EN ISO/IEC 17025 for the relevant test methods may be considered evidence of competence but does not in itself demonstrate compliance with all requirements applicable to Notified Bodies under Article 42 of the Construction Products Regulation.

VERIFICATION REPORT FOR THE APPLICATION OF ARTICLE 44 (ARTICLE 46)
A verification report concerning the application of Article 44 (Article 46) and the conditions under which it has been implemented shall be prepared by Efectis.
